BUYER REPRESENTATION

"Customer Service"   versus    "Client Representation"

Because the Buyer Agent must be loyal to the Buyer Client, the buyer can shop for a property in a less stressful environment knowing that the agent is not trying to "sell" a home. 

Additionally, the guarantee of confidentiality by the Buyer Agent allows the Client to freely provide the Buyer Agent with all the information necessary to get the best advice and counsel on matters related to the transaction.  Hiring a Buyer Agent enhances the buyer's competitive position against the other buyers in the marketplace.

By Agency Law,  the Buyer Agent must place the interest of the Client "Buyer" ahead of anyone else, including the agent.

How does a buyer become a Buyer's Agent Client?

The Buyer hires the Agent by contract using the NC Real Estate Commission's   "Exclusive Buyer Agency Agreement".  Once this agreement is signed by both Buyer and Agent, then the Real Estate Agent is bound by Fiduciary/Statutory responsibility to that Client.  The Buyer then moves from "Customer status" to "Client status",  a huge advantage for the buyer, under North Carolina Law.

This buyer real estate agency law is relatively new to North Carolina and it is an important advantage for buyers to become a Client for the all the reasons involving Agent loyalty and confidentiality.
